General Terms and Conditions
In our offer we include the specified property together with our services as real estate agents.
Despite all due care, we cannot guarantee that all offer details are correct and that the property is still available when accessing this offer.
Our commission rights will be effective if, due to information provided by us or through our mediation, a sales contract or a purchase option agreement are signed, even at a later point in time. Our commission rights shall also remain payable if the contracting parties enter into direct negotiations as a result of our activities. An closed assignment does not exclude the possibility that we may also be liable to carry out activities subject to commission for the other contracting party.
After mediation activities for houses, land or business premises, the seller shall pay 5% of the purchase price (minimum 1.500,- Euro) plus I.G.I.C. (Canary Islands VAT) to Casa Gomera S.L..
Upon conclusion of a purchase option agreement (preliminary contract for purchase security) the seller shall pay a commission of 2,5% of the purchase price. The remainder is due and payable on the day of conclusion of the notarial sales contract.
By receiving an offer, the interested party accepts our terms and conditions. The interested party undertakes to treat with confidentiality the content of the offers as well as the addresses of the properties offered and not to pass them on to third parties.
Since we have to rely on the information provided by third parties when offering the details of a property, our offers are non-binding and may be subject to mistakes.
All documents, confirmations, certificates etc. concerning the interested parties will be organised by us as soon as there is an intention to purchase, and the transfer of the property will also be prepared by us up to the notarial sales contract signature.
Place of jurisdiction is San Sebastian de La Gomera – Spain.
